1. Acceptance of Terms

By accessing or using MyWorkoutCalendar ("the Service", "we", "us") at myworkoutcalendar.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time. We will provide notice of material changes by posting an updated version on this page. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms.

2. Service Description

MyWorkoutCalendar provides a web-based platform for browsing curated workout programs, AI-powered workout plan generation, workout logging, and fitness progress tracking. The Service is provided for informational and personal fitness use only and does not constitute medical advice. Some features require a registered account and may consume tokens purchased separately.

3. Token System

Certain features — including AI workout generation and AI coaching — require tokens. Tokens are a virtual in-service currency and are subject to the following terms:

• Token packages are purchased through Creem, our payment processor.
• Token purchases are non-refundable once any tokens from the package have been used. If no tokens have been consumed, you may request a refund within 7 days of purchase.
• Tokens do not expire as long as your account remains active.
• Tokens are non-transferable between accounts.
• Token prices are displayed in USD and are subject to change. Price changes will be communicated with at least 14 days notice.
• Unused tokens are forfeited upon account termination for cause and are not eligible for refund.

4. User Accounts

To access certain features, you must create an account. By creating an account, you agree to:

• Provide accurate, current, and complete registration information.
• Maintain the confidentiality of your account credentials.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized access or security breach.
• Not share your account with any other person.

You must be at least 16 years of age to create an account. By registering, you represent that you meet this age requirement.

5. AI-Generated Content Disclaimer

The Service uses artificial intelligence (powered by OpenAI) to generate workout plans, coaching responses, and fitness recommendations. You acknowledge and agree that:

• AI-generated content is for informational and entertainment purposes only.
• AI-generated workouts do not constitute professional medical, fitness, or nutritional advice. Always consult a qualified healthcare or fitness professional before starting any new exercise program.
• AI outputs may contain errors, inaccuracies, or recommendations that are unsuitable for your individual health situation.
• You follow any AI-generated workout plan entirely at your own risk.
• We do not guarantee the accuracy, completeness, or fitness-for-purpose of any AI-generated content.

6. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe the intellectual property rights of any party.
• Upload or transmit harmful, threatening, defamatory, or obscene content.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Scrape, crawl, or systematically extract data from the Service without our written permission.
• Use the Service to develop competing products or services.
• Circumvent any technical measures we use to enforce these Terms.
• Create multiple accounts to abuse free features or trials.

7. Intellectual Property

All content, design, code, trademarks, and other materials on MyWorkoutCalendar ("Our Content") are owned by or licensed to us and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial purposes.

When you submit user-generated content (such as workout logs or feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content solely for operating and improving the Service. You retain all ownership rights in your content.

8. Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYWORKOUTCALENDAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFIT, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Users accessing the Service from Turkey acknowledge that, to the extent required by mandatory Turkish law (including the Turkish Code of Obligations and relevant consumer protection legislation), applicable Turkish law provisions may apply. Nothing in these Terms limits any rights you may have under mandatory consumer protection laws of your country of residence.

10. Dispute Resolution

We encourage you to contact us first to resolve any dispute informally. If we are unable to resolve a dispute within 30 days, you and MyWorkoutCalendar agree to resolve any claim, dispute, or controversy arising out of or relating to these Terms through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may seek injunctive relief in a court of competent jurisdiction.

Users in the EU or Turkey retain the right to bring claims before the courts of their place of residence to the extent required by mandatory local law.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, at our sole discretion. Grounds for termination include but are not limited to violation of these Terms, fraudulent activity, or chargebacks. Upon termination for cause, any unused tokens are forfeited without refund. You may terminate your account at any time by contacting us.
